Privacy Policy

We are AFCultures USA Inc. ("AFCultures," "we," "us"). We take the privacy, security, and confidentiality of your personal information seriously. This Privacy Policy explains what we collect through afcultures.com (the "Site") and when you contact us, how we use and protect it, who we share it with, and your choices and rights — including specific rights for California residents.

Notice at Collection

At or before the point of collection: we collect identifiers, order and payment information, the photos and videos you send for claims, and device and browsing data. We use it to fulfill orders, communicate with you, prevent fraud, operate and improve the Site, and — consistent with your choices — for marketing and advertising.

We do not sell your personal information for money, but we do share some browsing data with Meta and Google for online advertising. This counts as "sharing" under California law, even though we receive no money. You can opt out at any time, and exercise your other rights, using the methods in "Your Rights & Choices" below.

Personal Information We Collect

When you visit the Site we automatically collect Device Information — browser, IP address, time zone, cookies, the pages and products you view, and referral source — using cookies, web beacons, tags, and pixels.

When you make or attempt a purchase we collect Order Information — name, billing and shipping address, payment information, email, and phone number.

When you submit a claim or review, we collect the photos, videos, and messages you send us ("Claim Media").

Together we call this "Personal Information."

We do not collect or use sensitive personal information (such as government IDs, precise geolocation, or financial-account login credentials) to infer characteristics about you. To verify a privacy request, we match the information you provide against the records we already hold; we do not require a government-issued ID.

How We Use Your Personal Information

We use Order Information to fulfill orders — process payment, arrange shipping, and send confirmations and invoices — and to communicate with you, personalize your experience, improve the Site, respond to support requests, screen for fraud, and (consistent with the choices you have made) provide promotions about our own products and services.

We use Device Information to screen for fraud and to optimize the Site through analytics and marketing measurement.

We use strictly necessary cookies to run the store and checkout, plus analytics and advertising cookies and pixels. You can manage cookies in your browser, and use the opt-out and GPC mechanisms described below for advertising cookies. To learn more about cookies, see allaboutcookies.org.

Sharing Your Personal Information

We are not in the business of selling personal information for money. We share personal information only with:

  • Service providers / processors who perform functions for us under contract — for example Shopify (store platform), Brevo (formerly Sendinblue) for email marketing, our payment processor, and shipping carriers
  • Advertising and analytics partners, as described in "Advertising & the Global Privacy Control" below
  • Legal and safety recipients — to comply with law, respond to lawful requests, or protect our rights
  • A successor in connection with a merger, acquisition, or sale of our business, who must protect your information as we do

We do not share your personal information with third parties for those third parties' own direct-marketing purposes, so the access and opt-out request right under this law does not currently apply. Should this ever change, we will update this Policy and provide the required request and opt-out mechanism.

Advertising & the Global Privacy Control (GPC)

We run advertising campaigns on Meta and Google. To measure those campaigns and show you relevant ads, our Site uses the Meta Pixel and Google tags, which send certain device and browsing identifiers to those platforms. Under California law, this disclosure of online identifiers for cross-context behavioral advertising may be considered "sharing," even though we receive no money.

We currently do not upload your contact details (such as email or phone number) to Meta or Google for advertising; if that ever changes, we will update this Policy and continue to honor your opt-out.

You can opt out of this sharing at any time using the "Your Privacy Choices" link in our footer. We also treat the Global Privacy Control (GPC) browser signal as a valid opt-out of sharing for cross-context behavioral advertising in the U.S. states that require it.

Your Rights & Choices — California (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know and access the personal information we collect, use, disclose, and share
  • Delete personal information we collected from you (subject to legal exceptions)
  • Correct inaccurate personal information
  • Opt out of the "sale" or "sharing" of personal information
  • Limit the use of sensitive personal information (note: we do not collect sensitive personal information, so this does not currently apply)
  • Non-discrimination for exercising these rights

To exercise the right to know, delete, or correct, email [email protected]. To opt out of sharing, use the "Your Privacy Choices" link or enable the Global Privacy Control (GPC) in your browser. We will verify your identity before responding and may ask for information to confirm it matches what we hold. You may use an authorized agent (with written permission) to submit a request. We will not discriminate against you for exercising any right.

Children & Minors

Our Site is intended for adults and is not directed to minors. We do not knowingly collect personal information from anyone under 18. Consistent with the federal COPPA, we also do not knowingly collect personal information from children under 13, and we do not "sell" or "share" the personal information of consumers we actually know to be under 16. If you believe a minor has provided us with personal information, please contact us and we will delete it.

Data Retention

We retain your order and customer information for 5 years to meet legal, tax, and accounting requirements, after which we delete or de-identify it. Where a product carries a longer warranty, we keep the limited records needed to honor that warranty — such as your order number, the product built, and proof of purchase — for the duration of the applicable warranty period (up to 10 years for our longest-warranted signs). Marketing contact details are kept until you opt out or after a period of inactivity. You may ask us to delete your information as described above, subject to these obligations.

Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. Payment card data is encrypted in transit and handled by our payment processor; we do not store full card numbers. No method of transmission is 100% secure.

AFCultures — Section 13 — Text & Email Communications 13

Text & Email Communications

We send order-related notifications — such as order confirmations and payment, production, and shipping updates — to the email address and phone number you provide at checkout. These are service messages about your order.

We do not send promotional text-message (SMS) marketing. We may send email marketing about our own products if you have signed up or opted in, and you can unsubscribe at any time using the link in any marketing email. Message and data rates may apply to text notifications. No mobile opt-in or consent data is shared with third parties for their marketing.

Reviews

If you submit a review, we may, at our discretion, post and use it across our Site and marketing under a worldwide license, without compensation to you.

We may update this Policy to reflect changes in our practices or for legal or operational reasons. We will update the "Effective date" above.
